WESTJET PRICELESS HAWAII CONTEST
OFFICIAL CONTEST RULES (THE "CONTEST RULES"):
CONTEST OVERVIEW: The WestJet Priceless Hawaii Contest (the "Contest") is sponsored by WestJet, an Alberta partnership (the "Sponsor") and is administered by Armstrong Partnership LP (the "Administrator"). The Contest runs from 9:00:01 a.m. Mountain Time ("MT") on November 12, 2024, to 11:59:59 p.m. MT on November 26, 2024 (the "Contest Period"), and is subject to these official Contest Rules.
NO PURCHASE NECESSARY TO ENTER OR WIN.
1. ELIGIBILITY:
The Contest is open to individuals ("Eligible Entrants") who: (a) are residents of Canada who have reached the age of majority in their province/territory of residence at the time of entry; and (b) are either (i) cardholders (primary or secondary), as of November 20, 2024, of a WestJet RBC® Mastercard Card or WestJet RBC® World Elite Mastercard Card ("Eligible Card") or (ii) WestJet Rewards members ("WestJet Rewards Member") of a WestJet Rewards account. Employees, representatives, or agents (and those with whom such persons are domiciled, whether related or not) of the Sponsor, Mastercard Canada ULC ("Mastercard"), Royal Bank of Canada ("RBC"), Mastercard card-issuing financial institutions ("Card Issuers"), the Administrator, Octagon Inc. ("Octagon"), and their respective parent companies, subsidiaries, affiliates, distributors, and advertising/promotion agencies (collectively, the "Contest Parties") are not eligible to participate in the Contest. Royal Bank of Canada ("RBC") is not a sponsor of the Contest and is in no way responsible for the administration of the Contest, the verification of winners, or the fulfillment of prizes. All inquiries regarding the Contest should be directed to the Sponsor.
2. HOW TO ENTER:
No purchase necessary. There are two (2) ways to enter the Contest, as follows:
1) Online Entry: Eligible Entrants who are holders of an Eligible Card may enter the Contest, during the Contest Period, by visiting priceless.com/westjetPricelessHawaiiContest, clicking on the "Enter Now" button, and following the prompts (including providing their first and last name, email address, and contact telephone number and verifying their Eligible Card) to submit their entry.
2) Mail-in Entry: Eligible Entrants who do not have a WestJet RBC® Mastercard Card or WestJet RBC® World Elite Mastercard Card but who are a WestJet Rewards Member (there is no charge or fee to become a WestJet Rewards Member – visit https://www.westjet.com/en-ca/rewards for details) may request one (1) entry in the Contest, prior to the conclusion of the Contest Period, by hand-printing their full name, complete mailing address, email address, daytime phone number, WestJet Rewards account number, and the words "WestJet Priceless Hawaii Contest" on a plain piece of paper, along with a sentence of ten (10) words or more about their favourite island in Hawaii. Mail it in a sealed, stamped and hand-printed #10 envelope, bearing sufficient postage, to: WestJet Priceless Hawaii Contest", c/o 4211 Yonge Street, Suite 601, Toronto, Ontario M2P 2A9. To be eligible to receive an entry into the Contest, mail-in requests must be postmarked by no later than November 26, 2024, and received at the above address by no later than December 3, 2024. Compliant mail-in entry requests will receive one (1) entry into the Contest random draw taking place on the Draw Date, as provided in Rule 4 below.
There is a limit of one (1) entry per Eligible Entrant and per email address in the Contest, regardless of the method of entry (for greater certainty: (a) the primary cardholder and secondary cardholder of the same Eligible Card may each enter the Contest once, separately, provided they are each otherwise Eligible Entrants; and (b) an Eligible Entrant holding multiple Eligible Cards may only enter the Contest once). If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) obtain more than one (1) entry per Eligible Entrant/email address during the Contest Period; and/or (ii) use multiple names, identities, email addresses, and/or any automated, macro, script, robotic, or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest, then such person may be disqualified from the Contest in the sole and absolute discretion of the Sponsor.
If an entrant submits or purports to submit more than one (1) entry, all entries received after the first entry will be void. Those who do not follow all of the instructions, provide all required information in their entry form, or abide by these Contest Rules or other instructions of Sponsor may be disqualified at Sponsor's sole and absolute discretion. Sponsor reserves the right, in its sole and absolute discretion, to void (or to direct the Administrator to void) any and all entries of an entrant who Sponsor believes has attempted to tamper with or impair the administration, security, fairness, or proper conduct of this Contest. No photocopied, computer-generated facsimiles, mechanically reproduced, or mass entries permitted. All entries become property of the Sponsor and will not be returned.
All entries are subject to verification at any time. The Sponsor and/or Administrator reserves the right, in their sole discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor, including, without limitation, government-issued photo identification) to participate in this Contest. Failure to provide such proof to the satisfaction of the Sponsor within five (5) business days of a request for same from the Sponsor may result in disqualification. The sole determinant of the time for the purposes of a valid entry in this Contest will be the Sponsor's official clock.
Mobile Entry: Message and data rates (and additional charges, as applicable) may apply to the use of a mobile device for Contest entry. Please consult your wireless plan before participating in the Contest via mobile device. Not all mobile devices offer wireless internet access, and wireless internet access may not be available in all areas.
Entrant Privacy: Your submission of an entry constitutes your consent to participate in this Contest and your consent for Mastercard and the Sponsor to obtain, use, and share/transfer your name and email address and any other required entry information with, to, or between Mastercard, the Sponsor, the Administrator, and Octagon for the purpose of administering this Contest, awarding the Prizes, to comply with legal requirements, and in accordance with Mastercard's privacy policy, accessible at https://www.mastercard.ca/en-ca/vision/corp-responsibility/commitment-to-privacy/global-privacy-policy.html and the Sponsor's Privacy Policy accessible at https://www.westjet.com/en-ca/legal/privacy-policy. This paragraph does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use, and/or disclosure of that individual's personal information.
Except where prohibited by law, acceptance of a prize constitutes winner's consent to Sponsor's, Mastercard's, and their respective affiliates' and agents' use of the winner's name, likeness, photograph, voice, opinions, and/or city/province of residence for advertising and promotional purposes in any media, worldwide, without payment or consideration. You may be required to sign a document confirming your consent to this effect. Personal information of the Prize winner may be stored on servers located in the United States and, therefore, may be subject to the laws of the U.S. and/or other jurisdictions.
3. PRIZES:
There are four (4) prize packages (each, a "Prize") available to be won in the Contest, each consisting of a five (5) day, four (4) night trip for two (2) to Hawaii, consisting of the following:

• Round trip, economy air transportation for the confirmed Prize winner and one (1) age-of-majority guest from the major airport nearest the Prize winner's residence, as determined in the Sponsor's sole and absolute discretion, to Maui, Hawaii;
• Hotel accommodation (breakfast included) for the confirmed Prize winner and guest (double occupancy) for four (4) nights at a hotel/place of accommodation determined by Sponsor in its sole and absolute discretion (the "Hotel");
• Ground transportation to/from the airport in Maui, Hawaii, and the Hotel (on day of arrival and departure). Prize winner and guest are responsible for arranging transportation to and from the departure airport and their respective place of residence;
• One (1) "Welcome dinner" experience for the confirmed Prize winner and guest;
• One (1) "Molokini crater" snorkel experience for the confirmed Prize winner and guest;
• One (1) luxury "spa" experience at the Hotel for the confirmed Prize winner and guest;
• One (1) attendance (for the confirmed Prize winner and guest) at a traditional Hawaiian "Luau"; and
• One (1) USD $500 Mastercard Prepaid® card for the confirmed Prize winner.

The total approximate retail value of each Prize is CAD $33,000 (based on a representative departure from Halifax International Airport). The actual retail value may vary, depending on the departure point and due to market conditions, changes in value of the Prize components (e.g., air transportation and hotel rates), and for other reasons. Neither the Prize winner nor guest is entitled to any difference between the actual value of the Prize and the approximate retail value of the Prize. For the avoidance of any doubt, the Prize consists of the Prize package itself, and not the approximate or actual retail value of the Prize package.
The Prize trip must be taken and completed within the dates specified by the Sponsor in it sole and absolute discretion (currently anticipated to be between April 19 and April 23, 2025, but subject to change, at the sole and absolute discretion of the Sponsor).
Without limiting the generality of the foregoing, the following general conditions apply to the Prize: (i) the Prize must be accepted as awarded, must be taken at the time specified by the Sponsor, is not transferable, assignable or convertible to cash, and there can be no substitutions (except as may otherwise be specifically permitted by Sponsor in its sole and absolute discretion); and (ii) Sponsor reserves the right at any time to (a) place reasonable restrictions on the availability or use of the Prize or any component thereof and (b) substitute a Prize or a component thereof for any reason with a prize or a prize component of equal or greater value, including, without limitation, but solely at the Sponsor's sole discretion, a cash award. The Prize winner agrees to waive all recourse against the Contest Parties if the Prize or a component thereof does not prove satisfactory, either in whole or in part. Further, the Prize may be rescheduled, cancelled or substituted in Sponsor's sole and absolute discretion.
The Prize winner's guest must be of the age of majority in their province/territory of residence at the time of travel.
Contest Parties will not be responsible if the winner or guest are unable to travel or participate in the Prize, for any reason whatsoever, at the time specified by the Sponsor. Prize and Prize elements may not be separated or redeemed for cash. Travel and hotel restrictions apply. Winner and guest must travel on the same itinerary and on the dates determined by the Sponsor in its sole and absolute discretion and are responsible for obtaining and possessing all required valid photo ID, passports, and travel documents prior to travel. All travel must be arranged through the Sponsor's designated travel agency/provider and no changes will be made to travel details once any portion of travel arrangements have been made, except at Sponsor's sole and absolute discretion.
Sponsor and Administrator are not responsible for changes in schedule in any element of the Prize, and Sponsor and Administrator are not liable for any expenses incurred as a result of flight cancellation/delay. Winner and guest agree to comply with all applicable travel, venue and/or Hotel rules, regulations and policies in connection with the Prize. Sponsor and the applicable onsite representatives reserve the right, in their sole and absolute discretion, to remove or deny entry, to any venue or travel conveyance, to the winner and/or guest who behave(s) in an unruly or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person, or otherwise engage(s) in any other conduct otherwise considered to be objectionable by Sponsor or the applicable onsite representatives, whether during the Prize trip, the Hotel stay or at any venue. Prize winner and guest will be escorted out of the Hotel, venue, and/or any other Prize-related location or travel conveyance by Sponsor, the applicable onsite representatives, or their designated agent(s) for improper conduct and/or violation of federal, provincial, or local laws (including, but not limited to, the unlawful possession, use, or distribution of illicit drugs, unlawful drug paraphernalia, or alcohol) and, in the case of any such infraction, Sponsor will have no further obligation to Prize winner or guest and the Prize winner and/or guest will forfeit any further entitlement to the Prize, including any unused or undelivered element thereof. Released Parties (as defined in Rule 4 below) will not be responsible for weather conditions, acts of God, acts of terrorism, civil disturbances, work stoppage, or any other natural disaster outside their control that may cause the cancellation or postponement of any elements of Prize. All costs and expenses associated with the acceptance and use of the Prize not expressly specified herein as being included in the Prize, including, but not limited to, all federal, provincial, state, and local taxes, additional (or rescheduled) air and ground transportation, food, beverages, souvenirs, gratuities, airline luggage charges, incidentals, upgrades, insurance, service charges and other miscellaneous travel expenses are winner's sole responsibility. Prize winner may be required to present a credit card at Hotel check-in to cover any incidentals not expressly specified in these official Contest Rules as being included in the Prize. Prize winner and guest are responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel or other form of insurance.

4. WINNER SELECTION / NOTIFICATION / CONFIRMATION:
On December 4, 2024 (the "Draw Date"), at approximately 11:00 a.m. Eastern Time (ET), at 4211 Yonge Street, Suite 601, in Toronto, Ontario, four (4) eligible Entrants will be selected by random draw by the Administrator as the potential Prize winners from all eligible entries received during the Contest Period. The odds of being selected as a potential Prize winner are dependent upon the number of eligible entries submitted and received in accordance with these Contest Rules.
Subject to verification of eligibility and compliance with these Contest Rules, the potential Prize winners will be declared the official Prize winners of the Contest. The Administrator will make up to three (3) attempts to notify each of the selected entrants of their selection by email within seven (7) business days of the Draw Date (the "Notification Period"). If a selected entrant cannot successfully be contacted (including, without limitation, but for greater certainty, because notifications are returned as undeliverable) or does not respond to any notification within the Notification Period for any reason, then such selected entrant will be disqualified (and forfeit all rights to their prize) and the Sponsor reserves the right, in its sole discretion, to randomly select (or to direct the Administrator to select) an alternate Eligible Entrant for the applicable Prize from among the remaining eligible entries received in accordance with these Contest Rules (in which case, the foregoing provisions of this section shall apply to such new selected Eligible Entrant). For greater certainty and the avoidance of any doubt, the Sponsor does not have the obligation to select an alternate eligible winner.
By participating in this Contest and accepting the Prize, the Prize winner hereby (i) confirms compliance with these Contest Rules and acknowledges acceptance of the Prize as awarded and (ii) agrees to release the Contest Parties from any and all claims, damages, liabilities, costs, and expenses arising from any liability in connection with this Contest and/or their participation therein and/or the awarding and use/misuse of the Prize or any portion thereof.
Prior to being declared the confirmed winner of the Prize, each selected Eligible Entrant will be required to (i) correctly answer a time-limited, mathematical skill-testing question (without electronic, mechanical, or other assistance), which may be administered, at the sole and absolute discretion of the Sponsor, either at the time of Contest entry, by telephone or email, or in the below-described Sponsor's Declaration and Release; and (ii) sign and submit the Sponsor's Declaration and Release form within five (5) business days of the required return date indicated on the form or by the Administrator, which Declaration and Release form (among other things) (a) confirms compliance with these Contest Rules; (b) acknowledges acceptance of the prizes as awarded; (c) releases the Sponsor, Mastercard Canada ULC, the Administrator, Octagon, Royal Bank of Canada, Card Issuers (including, for greater certainty but without limitation, RBC) and each of their respective officers, directors, employees, agents, representatives, successors, and assigns (collectively, the "Released Parties") from any and all liability, loss, injury, or damage of any kind (including attorney's fees) to any person or entity, including, without limitation, personal injury, death or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of: (1) entrant's participation/entry into the Contest; (2) the acceptance, possession, use, or misuse of a Prize or participation in any activities associated with the Contest or any Prize awarded, including, without limitation, travel to/from the departure or arrival airports, activities, venues, and/or other elements of the Prize; (3) any alleged violation of rights of publicity or privacy, claims of defamation or portrayal in a false light or based on any claim of infringement of intellectual property; and (5) any typographical, human, or other error in the printing, offering, selection, operation, or announcement of any Contest activity and/or Prize; and (d) grants permission to the Released Parties to take visual and audio recordings in connection with the Contest and agrees to the publication, reproduction, and/or other use of their name, address, voice, statements about the Contest, and/or recordings, photograph, or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Released Parties in any manner whatsoever, including print, broadcast, or the internet. If an eligible potential winner (i) fails to correctly answer the mathematical skill-testing question; (ii) fails to submit the properly executed Contest documents required by the Sponsor (including, without limitation but for greater certainty, the Sponsor's Declaration and Release form); (iii) otherwise fails to comply with these Contest Rules; or (iv) cannot accept the Prize for any reason, then they will be disqualified and will forfeit all rights to the Prize. As noted above, in such event, the Sponsor does not have the obligation to select alternate eligible winners.
Prior to, and as condition of, being confirmed as an eligible guest of the Prize winner, the winner's proposed guest will be required to sign, within five (5) business days of receipt thereof from the Administrator, the Sponsor's form of release, confirming, among other things, the guest's province/territory of residence, that they are of the age of majority in such province/territory, and releasing the Released Parties from any and all liability of whatsoever kind or nature arising from such guest's participation in the Prize.
The Prize winner and proposed guest agree to cooperate in any investigations by the Contest Parties to confirm eligibility requirements for the Contest and to help ensure that the use of such winner and/or guest in advertising or publicity for the Contest will not bring the Contest Sponsors into public disrepute, contempt, scandal, or ridicule or reflect unfavourably on the Contest or the Contest Parties, as determined in their sole discretion, by the Contest Parties.
In the event the Sponsor or the Administrator is prevented from continuing with the Contest and/or the Prize as a result of any event beyond its control, including, but not limited to, fire, flood, pandemic, epidemic, earthquake, explosion, labour dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Contest by any party, or any federal, local, or provincial government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within the Sponsor's and/or Administrator's control, the Sponsor shall have the right to modify, suspend, or terminate the Contest or Prize. The Sponsor and Administrator additionally reserve the right, in their sole and absolute discretion, to: (a) modify, suspend, or terminate the Contest should causes beyond the Sponsor's or the Administrator's control corrupt or interfere with the administration, integrity, operation, security, or proper play of the Contest; or (b) disqualify any entrant found to be, or suspected of, (i) tampering with the entry process or the operation of the Contest; (ii) acting in violation of these official Contest Rules; or (iii) acting in an unsportsmanlike manner.
Released Parties make no warranty, guaranty, or representation of any kind concerning the Prize (or any portion thereof) and disclaim any implied warranty. Without limiting the generality of the foregoing, entrants agree that the Released Parties: (a) maintain no control over the personnel, equipment, or operation of any transportation company, hotel, manufacturer, or other person or entity furnishing services, products, or accommodations ("Suppliers") as a part of the Prize; and (b) will not be responsible or liable for any injury, damage, loss, expense, accident, delay, inconvenience, or other irregularity that may be caused or contributed to: (i) the wrongful, negligent or unauthorized act or omission on the part of the Suppliers or any of their agents, servants, employees, or independent contractors; (ii) any defect in or failure of any vehicle, equipment, instrumentality, service, or product that is owned, operated, furnished, or otherwise used by any of those Suppliers; (iii) the wrongful, negligent, or unauthorized act or omission on the part of any other person or entity not an employee of the Released Parties; and (iv) any cause, condition or event whatsoever beyond the control of the Released Parties. Sponsor's failure to enforce any term of these official Contest Rules shall not constitute a waiver of that provision.
5. GENERAL CONDITIONS:
By participating in this Contest, each entrant: (i) agrees to be bound by these Contest Rules; (ii) agrees to release and hold harmless the Released Parties from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement, or any other intellectual property–related cause of action; and (iii) releases the Released Parties from any and all liability in connection with this Contest and the entrant's participation therein.
The Released Parties will not be liable for: (i) any failure of any website during the Contest; (ii) any technical malfunction, interruption, failure, or other problems relating to any telephone or other network or lines, computer online systems, servers, access providers, computer equipment, or software; (iii) the failure of any entry to be received for any reason including, but not limited to, loss, technical problems, or traffic congestion on the internet or at any website or mobile network; (iv) any injury or damage to an entrant's or any other person's computer or other device related to or resulting from participating or downloading any material in the Contest; and/or (v) any combination of the above.
The Sponsor reserves the right, in its sole and absolute discretion, to withdraw, suspend, or amend this Contest in any way, in the event of an error, technical problem, computer virus, bug, tampering, unauthorized intervention, fraud, technical failure, or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of the Contest as contemplated by these Contest Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right, in its sole and absolute discretion, to cancel, amend, or suspend this Contest or to amend these Contest Rules, without prior notice or obligation, in the event of any accident, administrative, human processing error, other error of any kind, or for any other reason.
To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Contest Rules or the rights and obligations of participants, Sponsor or any of the other the Released Parties in connection with the Contest will be governed by and construed in accordance with the domestic laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction's laws. The parties hereby consent to the exclusive jurisdiction and venue of the courts located in Ontario in any action to enforce (or otherwise relating to) these Contest Rules or relating to this Contest. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entrants and/or entries.
The Sponsor reserves the right, in its sole and absolute discretion and without prior notice, to adjust any of the dates and/or time frames stipulated in these Contest Rules, to the extent necessary, for purposes of verifying compliance by any entrant or entry with these Contest Rules, or as a result of technical problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Contest Rules.
In the event of any discrepancy or inconsistency between the terms and conditions of these Contest Rules and disclosures or other statements contained in any Contest-related materials, including but not limited to the French version of these Contest Rules, point of sale, television, print or online advertising, and/or any instructions or interpretations of these Contest Rules given by any representative of the Sponsor, the terms and conditions of this English version of the Contest Rules shall prevail, govern, and control to the fullest extent permitted by law.
All intellectual property, including but not limited to trademarks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans, and representations relating to the Contest are owned, as applicable, by the Sponsor, Mastercard, RBC, the respective suppliers, and/or their affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
